PART 1
Identify the section of the Constitution or its amendment that you have chosen. Discuss how this section of the Constitution or its amendments both limit and protect business in general.
Amendment I:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. (Seaquist, 2012).
Essentially, the first amendment supports the freedom of speech, which is a basic and protected right of all American citizens. This is a wonderful thing for many individuals, especially in the #metoo movement, the Martin Luther King Jr. speech and anti-cyber-bullying attacks. The freedom of speech can be a powerful aid in furthering business and support of individuals and societies. However, the freedom of speech can hurt or limit a business when an individual says things, which put the business in a bad light. If an individual is speaking on things which are against the law, against prevailing societal beliefs and ethics, and are in support of violence or harm of a child, this can cause the business, associated with this individual, to become limited and set on a decline. In extreme cases, complete separation between that specific business with the specific individual, is mandatory before business can progress forward towards success once again.
Describe an example of how the section of the Constitution or its amendment that you have chosen could be applied to your professional life (past, present, or future). In your example, discuss whether the section of the Constitution you have chosen to address limits business or protects it.
I work for a privately owned business where the top executives have, very recently, mandated the Covid vaccine for furthered and secured employment. Those who have not chosen to become vaccinated by a specific date, rendered their two weeks resignation by default. There were a few who refused to be vaccinated and were separated from the company once that set date came and went. There were others who became vaccinated but decided to incite others to act angrily and revolt against leaders – leaders, who had no choice in the matter. It was a very sad day in our business when, several of these individuals, were either selectively or forcefully separated from the company, because of the threats and psychological harm done by the choices of their words.
We have the freedom of speech; however, we do not have the freedom to choose the consequences of our speech.

PART 2
Identify the section of the Constitution or its amendment that you have chosen. I chose the first amendment because it has such a gray area.

Limits: People can say what they want about your business and you can not stop them. Unfortunately, we live in a world where media is a big influencer. So, even if it is a lie, if it travels the damage will be done. It is hard to erase those perspectives.
Protects: The constitution does not protect illegal, rioting-inducing speeches. So with this being said, people are not allowed to harass a business. You can also consult with a lawyer to get a cease and desist letter.

I think honestly, it puts me in the perspective of living in a glasshouse. It also makes me have a meticulous stance when it comes to thinking before I speak. Let’s consider Donald Trump for example. Facebook and Twitter limited his speech and I feel that to do that permanently was a bit much. A lot of people don’t pity him because of his perspective, so they don’t understand how wrong that is. However, I put myself in his shoes as a business owner, i can only imagine how that limited him in that aspect.
